Every older coastal condo is now on a six-month clock

Florida's Dec 31 milestone-inspection deadline is here. If you're buying or own in a pre-1996 coastal building, the inspection status matters more than the price.

Florida Statute 553.899, created by SB 4-D in 2022, sets a Dec 31, 2026 milestone inspection deadline. It applies to buildings 30 or more years old, or 25 or more if within three miles of the coast, that are three or more habitable stories, in Miami-Dade and Broward counties.

The process runs in stages. Phase 1 is a visual review. If substantial deterioration is found, a Phase 2 inspection is required within 180 days, and repairs must begin within 365 days of that Phase 2. Alongside it, structural integrity reserve studies must cover the roof, load-bearing structure, waterproofing, exterior painting, and foundation.

What this means if you're buying

In an older coastal building, the inspection file is more important than the listing photos. A clean Phase 1 is a green light. A Phase 2 finding, or a reserve study that reveals underfunded structural work, can mean a special assessment landing on your unit after closing. That's real money the price tag doesn't show.

My read: this law is quietly repricing the older-condo market. Buildings that did the work and funded reserves are worth a premium. Buildings that deferred it are cheap for a reason. Owners in pre-1996 stock need to know their board's exact timeline, because the difference between a proactive board and a stalling one is the difference between a manageable line item and a five-figure surprise.

  • Pull the milestone inspection report. Ask for Phase 1, and Phase 2 if one was triggered.
  • Read the reserve study. Confirm the structural line items are funded, not just acknowledged.
  • Ask about pending special assessments. Get it in writing from the association, not the seller.
  • Check the repair timeline. A building mid-repair can mean noise, scaffolding, and cost for years.
  • Compare fees to funded reserves. Low HOA dues plus empty reserves is a warning, not a bargain.
