106 Days to December 31: What Every Miami Condo Buyer and Seller Must Have in Hand

The statutory milestone-inspection deadline for older coastal condos arrives at year end, no extension has been enacted, and the reports are now a price issue.

Florida Statute 553.899 requires a milestone structural inspection by December 31 of the year a condominium or cooperative building of three or more habitable stories turns 30, or 25 where the local enforcement agency requires it based on environmental conditions such as proximity to salt water, and every ten years after that. For a large share of Miami-Dade's older coastal buildings, the statutory clock runs out on December 31, 2026, 106 days from today. No extension has been enacted as of this writing.

How the inspection works

  • Phase one is a visual examination of habitable and non-habitable areas by licensed professionals, due within 180 days of the building receiving written notice.
  • Phase two is triggered only if phase one finds substantial structural deterioration. It may involve destructive or non-destructive testing, and a progress report is due within 180 days of the phase one report.
  • Repairs for substantial deterioration must commence within 365 days of receiving that report.
  • Miami-Dade has required 40-year recertification since 1975, so many buildings here carry a local history of reports on top of the state requirement. Secondary sources describe the 25-year trigger as applying within three miles of the coast.

My read

I will not quote you a compliance percentage, because the only figure circulating is from February 2025 about the 2024 deadline, and it is meaningless now. What I can tell you is how this plays out at the closing table. Buyers: ask for the milestone report, the structural integrity reserve study and the last two budgets before you go hard on a deposit in any building over 25 years old. Sellers: a missing or ugly report is now a price issue, not a disclosure footnote, and it is a big part of why condos sit at roughly twelve months of supply while houses sit at five. Associations: the phase-one clock is 180 days, which means a building that has not started is already late.
